📜 General Conditions of Travel | Trogir Travel Agency

These General Conditions regulate the relationship between Trogir Travel Agency, owned by Fulmar d.o.o. (Obala Dr. Nikole Lozovine 12, Seget Donji – Trogir, Croatia, ID HR-AB-21-060326472), hereinafter referred to as “the Agency,” and the Traveler (client or third party for whom travel is arranged) regarding all organized excursions and tours.
If another company acts as the main organizer, Trogir Travel serves only as an authorized intermediary. The trip organizer is stated on the Certificate of Trip Purchase (voucher/receipt).
🧾 Booking and Payment
By paying for an excursion and providing necessary information (in person, by email, fax, or online), the Traveler enters into a binding Excursion Agreement with the Agency.
Unless stated otherwise, the Traveler must pay the full price at least 24 hours before departure.
📦 Contents of the Excursion
The excursion price includes all services specified in the program.
Additional services (e.g. transfers, tickets, meals, tips) not included in the published price can be arranged upon request and must be paid separately.If prices for such services are not stated in advance, the Agency will notify the Traveler before confirming the booking.
For services payable on site (foreign taxes, entry tickets, etc.), the Traveler is responsible for any complaints directly with the service provider.
⭐ Categorization and Description of Services
All accommodations, restaurants, and transport services are described according to the official categorization of local tourist authorities. Standards and service quality may vary between countries and regions.
The Agency is not liable for any information inconsistent with official descriptions or received from unauthorized sources.
📣 Promotional Materials and Notifications
The Agency is not liable for printing errors or later changes in promotional materials published after the Traveler’s booking.
Sales staff are required to provide all relevant information, border/visa/health formalities, and General Conditions in written or electronic form before purchase.
🗺️ Itinerary and Excursion Schedule
The itinerary binds both the Traveler and the Agency.
Travelers must follow the instructions of the guide or representative regarding departure times, regrouping, and itinerary continuation.Failure to appear on time will be treated as a cancellation by the Traveler.
The Agency is not responsible for itinerary changes due to weather conditions or events beyond its control (turbulent sea, bad weather, etc.).
💰 Trip Prices
Prices are stated in the excursion program and valid from the program’s publication date.
The Agency reserves the right to change prices up to 7 days before departure due to:-
changes in taxes or exchange rates

fuel surcharges or transport cost increases

changes in airport or port fees
If fewer travelers than the minimum required apply, the Agency may propose a new price or cancel the excursion with a full refund.
If the price increases by more than 10%, the Traveler may cancel and receive a refund without additional compensation.
🔄 Changes and Cancellations
The Agency will inform the Traveler immediately of any itinerary or schedule changes.
Excursions may be cancelled or modified due to force majeure such as:
war, strikes, terrorist acts, epidemics, government regulations, extreme weather, or transport delays.If minimum group numbers are not met, the Agency may cancel the tour and refund all payments.
The Traveler can accept a modified excursion or an alternative date.
If the Traveler refuses, the contract terminates and a full refund is issued.
💳 Payment Terms & Cancellations
Deposit:
30% deposit is required upon confirmation to secure your booking. Deposits are non-refundable.Final Payment:
The remaining balance must be paid 21 days before arrival.Cancellation Policy:

0–7 days before departure: deposit & balance retained

7–14 days: deposit retained, 50% of balance refunded

14–21 days: deposit retained, full balance refunded
🧍♂️ Traveler’s Documents and Safety
The Traveler must carry all required travel documents, passports, visas, and health papers.
The Agency is not responsible if border or transport authorities deny travel.Travelers must comply with hotel, transport, and local regulations and behave responsibly.
Loss of travel documents, theft, or medical emergencies are the Traveler’s responsibility.
👥 Passenger Replacement
If unable to travel, the Traveler may assign a replacement passenger who meets all travel requirements and notifies the Agency in writing before departure. Any administrative costs for replacement will be charged.
🎒 Luggage
The Agency is not liable for lost, stolen, or damaged luggage.
Special luggage (sports equipment, instruments, etc.) must be announced in advance and may incur additional fees.Travelers must keep personal belongings under supervision; the Agency bears no responsibility for items left unattended.
Pets are not allowed unless approved in advance at extra cost.
📩 Complaints
Complaints must be reported immediately at the location of service delivery to the local provider and Agency representative.
If the issue is not resolved, a written complaint must be submitted within 8 days of return to the Agency’s office.The Agency will respond in writing within 15 days, or extend by another 15 days to verify information.
Group complaints or those without documentation may be rejected.Maximum compensation cannot exceed the cost of the unused portion of the excursion.
🌍 Excursions by Other Organizers
For excursions where the Agency acts only as an intermediary, the General Conditions of the responsible organizer apply.
⚖️ Final Provisions
By purchasing a trip, the Traveler confirms that they:

Have read and accepted these General Conditions

Have been informed of visa, border, and health formalities

Have been offered optional travel insurance (cancellation, accident, medical, luggage)
Disputes will be settled amicably; if unresolved, jurisdiction lies with the Court in Trogir, under Croatian law.
