General information on contracting

Terms of the Travel Organization and Mediation Contract

1. General Provisions

These Terms and Conditions govern the relationship between the travel organizer, intermediary agency, and travel agents, as well as third-party passengers when a travel contractor concludes the contract on behalf of or for the benefit of another person.

2. Contract Parties

The contracting parties include:

  • Travel Organizer / Service Provider – the entity responsible for organizing or providing travel services.

  • Agency / Mediator – the intermediary who arranges services on behalf of the passenger.

  • Passenger / Customer – the individual benefiting from the contracted travel services.

3. Contract Formation

The contract becomes legally binding once it is signed or clearly confirmed by any means (e.g. online booking, email, fax, credit card authorization, or bank payment). Legal effect begins once the agency receives full or partial payment as agreed.

4. Obligations of the Agency

The Agency shall provide the passenger with all services agreed in the contract, ensure quality and safety, and act in accordance with standard business practices. The Agency is responsible for losses resulting from non-performance, partial performance, or disruption of contracted services, up to the total price of the arrangement.

5. Obligations of Organizers and Service Providers

Organizers and providers must honor all information presented in official programs or promotional materials unless otherwise stated or changed by mutual agreement.

6. Prices and Adjustments

Prices may be increased up to 20 days before departure if exchange rates, transport costs (including fuel), or taxes/fees change.
If the increase exceeds 10%, the passenger may cancel the trip and receive a full refund (excluding visa, insurance, or vaccination costs).

7. Termination by Organizer or Agency

The organizer may terminate the contract if:

  • Payment or required documentation is not received within the agreed time.

  • Minimum group size is not met.

  • Extraordinary and unavoidable events occur (e.g., natural disasters, war, strikes, epidemics).

In such cases, passengers are entitled to a refund but not to compensation for additional costs.

8. Amendments and Substitutions

Before travel, the organizer may offer an amended contract or alternative arrangement.
The passenger has 2 business days to accept or reject it.
If rejected, the contract terminates and all payments are refunded.

9. Force Majeure

If extraordinary circumstances (e.g., natural disasters, riots, strikes, delays) occur after departure, the organizer may modify the itinerary. Any price difference for unprovided services will be refunded.

10. Written Termination by Passenger

Passengers may cancel the trip at any time in writing. The organizer will charge cancellation fees as stated in promotional materials or general conditions.

11. Passenger Replacement

If unable to travel, a passenger may transfer their booking to another person who meets all travel conditions. Any additional costs from the change must be paid before departure.

12. Traveler Information

Passengers must inform the agency of any medical conditions, dietary needs, or habits that could affect travel. The agency is not liable for any issues arising from undisclosed information.

13. Travel Documentation

Passengers must collect all travel documents (vouchers, itineraries, contact details) no later than 8 days before departure. Failure to do so releases the agency from related responsibility.

14. Passenger Responsibilities

Passengers are responsible for complying with all passport, visa, customs, and health regulations. The organizer is not responsible for denied entry or loss of documents. Travelers must follow programs and cooperate with representatives.

15. Last-Minute Arrangements

“Last minute” or “no name hotel” bookings (Fortuna, Roulette, Joker, etc.) involve specific risks. The passenger accepts these uncertainties and waives the right to complaint on such grounds.

16. Complaints

Complaints must be reported immediately during the trip to allow on-site resolution.
If unresolved, a written complaint must be submitted to the organizer within the period stated in the general travel conditions.
Late or unsubstantiated complaints will not be considered.

17. Court Jurisdiction

All disputes fall under the jurisdiction of the court at the travel organizer’s registered seat.

18. Minors

When signing for a minor, the parent confirms that the other parent is informed and consents to the contract.

19. Personal Data Protection

By entering into this contract, the passenger consents to the processing of their personal data for the purpose of fulfilling travel arrangements, communication, and legal compliance. Data may be shared with third parties involved in service delivery, in accordance with privacy regulations.

20. Insurance

Passengers acknowledge that they have been informed about optional travel insurance covering trip cancellation, illness, injury, death, or loss of luggage, and assistance in case of accident or illness.

21. Insolvency or Bankruptcy

In accordance with applicable tourism legislation, passengers are protected in the event of the agency’s insolvency or bankruptcy.
